Do You Qualify for Unemployment?

 

You can get unemployment if you can answer "Yes" to all three of these questions:

EXPLANATION: The amount of benefits you get depends on how much money you made in the 12 months before losing your job. This is called your base period.

EXPLANATION: If you were laid off, fired, or left the company for a good reason (like an illness), you could qualify. You will not qualify if you quit your job.

EXPLANATION: You must be ready, willing, and able to work. You can’t be too sick, injured, or disabled to work.

My boss was yelling at me every day for no reason. He even told i me looked cute with both my ears pierced. Then one day he said quit or get fired. I couldn't take it any more so i called in thay called me an fired me. I told the guy at the hearing all of this do you think i'll get unemployment?

I was recently laid-off from a 501(C)(3) school due to a Board directed change in teacher requirements. The school opted-out of the SUI. I since have filed for unemployment benefits and was denied three times due to statements from the school, all false: 1. I received no wages, 2. They were exempt as a soley religious organization, 3. The question is, since the employer made false statements in all three cases to the State, will they be automatically be held accountable for perjury?

I spent 2 years working for a 501 (c) (3). I was laid-off due to the school changing their teacher qualifications. I applied for benefits and the state replied that they were told I received no wages. I showed the state my pay-stubs and W-2's. The state was then told by the employer that the employer was run for religious purposes only and was principally funded by a church. I showed the state that neither was the case. The state was then told by the school that I "quit". This too was false and I proved it. At this point I have to wait four (4) weeks before I can contact the state to determine the status of my case. The employer (a Christian school no less) has lied to the state about my status three times and I have clearly shown this in my three replies. Any ideas where I go from here? File a civil action against the school and state in superior court? Contact the IRS about the 501 (c) (3) status? Contact the County Attorney about attempted fraudulent statements? This is in Arizona and any help would be greatly appreciated.

My wife and I work in Oregon. Recently we brought a new bundle of joy into our world. Our baby was born with complications and spent the first 2 weeks of her life in ICU. Since then she has had two followup surgerys.Our baby is now 3months old but not taking a bottle. We can get a letter from the babys doctor saying she need more time. Due to all of this my wife has not been able to return to work. Her work has given her FMLA and LOA to work with her. It seems like it is only a matter of time befor they release her. I worked at my place of employment for 2 years 9mo. I am now 4 months pregnant and high risk. My employer acted out in a hostile behavior yelling for no reason. When i asked him to call down and talk to me in a reasonable manner. He called me a name grabbed my pay plan and shredded it in my office. He told me a few minutes later i had to decide it i would work for him. I was forced to leave by his behavior. The stress and anxiety was so overwhelming that i couldnt risk it. Earlier that day he had told me he changed my pay plan, but hadnt given it to me yet. He reacted irrationally about an hour and a half later. He has always been hard to deal with, but he seemed to get worse since ive been pregnant. Please let me know what you think...

I have worked with this company for 7 months. I was fresh out of school and hired on at my extern site. I was hired as a subcontractor. But the thing is, she only gave me a 30 day contract agreement, but still kept me on the job. I come to work everyday on time and do my job to the best of my abilities. My boss is constantly holding my job over my head. I have a 7 year old and I am a single mother. So I do my best to perform to the highest level to support my child. I have asked about signing another contract, my boss has yet to sign one with me and now she is saying that she is giving me and week and depending on how I do in that week.She will based her decision, as far as if she will keep me or not. With this economy I can't afford to loose my job and have no income. If she fire me will I qualify for unemployment?

Hi, I was just denied for unemployment. My husband and I planned to relocate to the west coast last year when my grant funded position in NYC ended in august. In april, I was laid off for lack of funding and we moved early. That is all fine with the UI. The problem is that I optimistically spent six months looking for work before I applied for unemployment, so I've been denied for lack of wages during the base period -- the 12 months prior to filing. I feel like I'm being denied unemployment because I'm unemployed! Can I request an alternate or extended base period?

My daughter worked in Raleigh for a company that moved to Virginia and has been receiving unemployment benefits. She immediately decided to go back to college full-time and try to receive her degree, which should be in December 2011. She recently received a letter for an interview and was asked to bring with her all her attempts to find employment. Unfortunately, she hasn't been looking for work because she thought that if she went back to college full-time with FASFA and all the loans she took out to finish and get the degree to find a great job that she didn't have to. You know how they encourage you if you are unemployed to go back to school. What danger does she face if any if she confronts them at the interview and explains she thought if she was going to college to better herself that she could still continue to receive her unemployment benefits. Help!! Is this a sufficient answer? If not what should she say at the interview, of course, she wants to be totally honest. She thought that she honestly could continue full-time her education and still receive benefits. She didn't try to get a part-time or full-time because she thought she might not get the money she needed to finish college. Thanks!!

I got laid off late September, working in South Carolina. Three weeks later, after not being able to find another job, I filed for unemployment benefits. Approximately 3 weeks after filing I had to pack up and move back home to Louisiana because I could not pay my rent and other bills. I was forced to leave on a Saturday and was unable to go into the unemployment office, there in S.C., because they were closed. So after I got back to Louisiana, I called The S.C. unemployment office to explain what happened and to find out where to go from there to still get my benefits. They told me that there were some things I still needed to get straight with them before we could move any further but I would have to come back into their office to do so. I was told I couldn't do it over the phone. But that would be pretty much impossible, since I now live fourteen hours away. Finally I was told to file an interstate claim, from a toll free number I was given. But I kept getting a recording that was only telling me what time I can call in to file for the week. Nothing else. So long story short, I got frustrated because I couldn't get any help in figuring this all out, and gave up. I figured it was too much hastle and I could just find another job before I'd ever get any kind of benefits. It was taking way too long, it seemed. But now, every since I've been back in La., I haven't been able to find a job. Is it too late to try and file again? And if not, where do I begin? It's been since late September since I've been unemployed.

I worked over 10 years in the warehouse dept. and I still work in this company. The warehouse moved to a different state and they offered me a job in the office to maintain working there. But now the office moved further than I usually travel. I expected a raise increase as I was working in the warehouse and now in the office but none was given to me. I went in to work this morning only to have my boss tell me that they were going to have to "let me go". He wants me to sign a release that basically says I'm resigning, and he is offering three weeks pay as severance. I am fairly certain this will make me ineligible to collect retirement benefits so I'm reluctanct to sign.................................................................................................................................................................................................................................................................................................................. I had my annual review about a month ago and I WAS told at that time that there were some things I needed to work on (my timeliness to the morning meeting and adhering to scheduling). I feel like I have made improvement in those areas, although I acknowledge that there was room for more improvement and I hadn't completely "fixed" the problems. At the review they did tell me that these things were things that could result in me being let go if I didn't work to fix them. When I pointed out that they (my bosses) were being hypocritical because another employee and my supervisor both sometimes have the same problem (being 1-2 minutes late to the morning meeting, or disregarding the schedule), I was told "this meeting is about you; it doesn't matter what so-and-so does". ................................................................................................................................................................................................................................. At my performance review my boss said I needed to decide what I wanted to do for my future and that if I decided I didn't want a future with the company we needed to work together to find a "healthy way" for me to leave- and here my boss specifically said he did not mean "there's the door"- leading me to believe that, if they did decide things weren't going to work that I would at least be able to search for another job while having the security of this one. ................................................................................................................................................................................................................................... My supervisor was supposed to work with me and develop a plan to help me correct these mistakes by December 15th. On September 4, 2010, during my work shift my immediate supervisor, the manager, Tenille verbally threatened to demote me and my wages for asking if she followed through with the instructions she gave the whole crew to follow. I am tired of being under appreciated by my manager and my company. I feel this is disrespectful to me and my wife and mostly the company. My son was hired in October of 2009 by a Store Chain. He applied for a management position immediately after he was hired and was given the position due to his education status. He had just begun his "training" and several of the other employees who had been there for awhile began giving him a hard time. NOW, he was told he wasn't allowed to copy his schedule anymore. He had to write it down. They would still change his schedule and he would not be notified. After another employee witnessed this, he had to be given 24 hours notice when the schedule was changed. Multiple attempts have been made for him to quit his employment. Now he has been terminated from his position due to not following a company policy. And he wasn't the one that didn't follow the policy. His store manager said he would be ok, because it was on tape, but now the tape disappeared. He was the manager over someone else who did not follow the policy and he told him not to do it, but he did it anyway and both were terminated . My son had actually signed a Termination notice that state his employment would end one week after he had signed the paper. Then he received a call that stated he could go back on September 1st, part time at a lesser rate and for a lower position that does not have the benefits that he had. Can he or should he sign up for unemployment since he is now being told that he was only demoted, not fired? He has no desire to return. He is very anxious and depressed. He feels that the other employees would only make it even worse for him. Any feedback would be appreciated.

I work for a company and employed through a management company. I am expecting new ownership to necessitate termination of all employees of the current company and management company. From there, the new owners will rehire. Positions and titles offered may be the same or different. I am concerned and wondering my rights to unemployment if I am offered a position, but not of the same salary.
